
The Ministry of Agriculture refuted statements that the draft of the new Land Code allows foreigners to own agricultural land in Moldova.
In particular, the agrarian ministry called the interpretation of the rules concerning the sale of agricultural land to foreign citizens erroneous. The Ministry of Agriculture and Food Industry reported that Art. 21 of the draft Land Code clearly regulates that “foreign individuals and legal entities cannot acquire ownership rights to agricultural land or from the Forest Fund through title documents under pain of recognizing the absolute invalidity of the title document on acquisition.” It was also established that in case of obtaining the said lands in the order of succession, the heirs are obliged to alienate them within 1 year. If the land has not been expropriated within the prescribed period, the local authorities will take action to sell the land at market value on the basis of a valuation report drawn up in accordance with the provisions of the Law on Valuation Activities from the person who does not have the right to own it.. Earlier, Forta Fermierilor (Farmers' Power) Association stated that the new draft of the Land Code granted "green light" to companies with foreign capital to own agricultural land in Moldova, and it has no limitations for companies of this type to own Moldovan agricultural land. // 30.01.2023 – InfoMarket
