
In Moldova, airline passengers will receive higher compensation in case of lost or damaged luggage and flight delays
In particular, this is stipulated by the draft amendments to the Law on Civil Liability and Insurance Requirements for Air Carriers and Aircraft Operators, passed by the Parliament in the second reading. The draft law stipulates an increase in civil liability insurance for passengers, baggage, mail and goods and was adopted in order to bring national requirements in this area in line with international standards. Thus, it was proposed to increase the minimum insurance requirements for air carriers and aircraft operators operating flights in Moldova. According to the authors, the increase in the minimum amount of insurance will ensure greater financial protection of passengers in case of accidents, loss, destruction or damage of luggage, mail and cargo. In particular, the authors of the document proposed to increase the minimum limit of civil liability insurance for passengers for damage caused by delays from 5346 Special Drawing Rights (SDR) to 6303 SDR per 1 passenger, which will amount up to 22 thousand lei, according to the exchange rate of the National Bank of Moldova. In case of luggage, the minimum limit will increase from 1288 to 1519 SDRs for each passenger (36 thousand lei). As for cargo transportation, the minimum amount will be 26 SDR per 1 kg. The legislative initiative was elaborated by the Ministry of Infrastructure and Regional Development in cooperation with the Civil Aviation Authority, in the context of the provisions of the Montreal Convention of 1999, signed by Moldova. The Convention provides for periodic revision of liability limits in accordance with an internationally determined inflation coefficient.
