
In Moldova, some beneficiaries of social pension/disability allowance will be able to receive simultaneously a survivor's benefit
This is provided for by amendments to the Law on State Pension System and the Law State Social Benefits, passed by Parliament in the first reading to ensure access to equitable social support for children with disabilities and disabled children with severe disabilities. Thus, in case of loss of a breadwinner, children with disabilities and disabled children with severe disabilities who receive social benefits will also receive a survivor's pension/benefit at the same time, if such a situation arises. At present, children with severe, pronounced and moderate disabilities receive an average of 2083.4, 1944.5 and 1388.93 lei monthly, respectively. This pension is paid to them until they reach the age of majority. At the same time, the beneficiaries are not entitled to receive other benefits than care and accompaniment. This also applies to the survivor's benefit - such children cannot receive it today. There are also legislative gaps in the social protection of people with severe disabilities - they cannot exercise the right to study until they reach the age of 23 and are dependent on the people they depend on. Accordingly, when they lose their breadwinner and reach the age of majority, they remain without means of subsistence. After the amendments, children with disabilities and adults disabled from childhood in case of loss of the breadwinner will be able to receive two benefits simultaneously. It should be noted that the amount of survivor's benefit is calculated as 40% of the minimum retirement pension and from April 1, 2024 is 1111.14 lei per month. The authors of the legislative initiative note that the amendments will require 927 thousand lei in 2025, 19 million lei in 2026 and more than 3 million lei in 2027.
