
Starting March 1, 2023, pregnant women on prenatal leave will be able to work while receiving both salary and maternity allowance.
The relevant legislative amendments were published on Friday in Monitorul Oficial (the Official Journal of Moldova). According to the amendments to the Labor Code, during maternity leave, the employer, upon written request of the employee, will be able to order the continuation or resumption of her employment for the requested period. However, the woman must present a medical certificate on her state of health, and she will be able to work only up to the 36th week of pregnancy. It is also specified that the maternity allowance will be calculated based on the insured income of the spouse whose income will determine the largest amount of maternity allowance. A maternity allowance will be paid for the entire period of maternity leave, which coincides with the period in which the woman receives uninsured income. The same right to continue working and receiving maternity allowance will be available to women who hold the office of district chairperson, his/her deputy, mayor and deputy mayor.
