The Public Services Agency changed the procedure for considering applications for registration of condominiums and the Association of Condominium Owners.

The Public Services Agency (PSA) informs that practically all the norms established in the Condominium Law came into force on January 29 (with the exception of some articles that will come into force on July 29, 2023). To implement the provisions of the law, the Public Services Agency has established a new procedure for considering applications for registering a condominium in the Real Estate Register and simultaneously considering applications for registering associations of condominium owners in the State Register of Legal Units. In particular, the Public Services Agency's pre-registration system will be adjusted to efficiently manage the simultaneous filing of applications for condominium registration and registration of owners' associations. It is noted that if the act on the establishment of a condominium indicates that the owners are organized in the form of an association, then an application for registration of a condominium is submitted at a multifunctional center serving a settlement located in the service area of the territorial cadastral authority. In the same multifunctional center, it will also be possible to apply for registration of a condominium association, that is, owners in a real estate complex. Associations of co-owners in a condominium, created before January 29, 2023, retain their status, which is the basis for registering for the purpose of changing the legal form and the full and abbreviated name of the association in the State Register of Legal Entities. The change is registered without the publication of a corresponding notice in the Monitorul Oficial and without payment of a registration fee. Herewith, within 18 months from the date of entry into force of the Condominium Law, privatized housing/apartment owners associations, housing cooperatives and housing cooperatives must be reorganized by transforming into condominium owners associations.
