
The National Agency for Energy Regulation called the information disseminated by Nordgaz Furnizare that the court recognized the illegality of the suspension of its license as manipulative and untrue.
As noted in the message of the National Agency for Energy Regulation, on December 22, 2023, at a meeting of the NAER Administrative Council, a decision was made to suspend Nordgaz Furnizare’s license for the supply of natural gas on the grounds that the company violated the regulatory framework for activities in the wholesale natural gas market (REMIT terms). According to Art. 278-10 of the Civil Procedure Code of Moldova, within 3 days from the date of the decision, NAER appealed to the court with a request to confirm its legality. By the decision of the Balti Court of January 4, 2024, NAER’s request was fully satisfied, and the license of Nordgaz Furnizare was suspended, which confirms the legality of NAER’s decision of December 22, 2023. As noted in NAER, after Nordgaz Furnizare eliminated the violations that served as the basis for the suspension of the license, they went to court in accordance with the procedure established by law. According to Art. 278-14 of the Civil Procedure Code of Moldova, after eliminating the circumstances that led to the suspension of the permitting act in relation to the activities of the entrepreneur, the court that made the relevant decision, at the request of the entrepreneur or the competent authority, initiates a lawsuit and within 5 days announces a decision that cancels the suspension of the relevant permitting act. Pursuant to this decision, the competent authority makes a decision on the resumption of business activities. The energy regulator noted that during the period of suspension, the license holder Nordgaz Furnizare took full advantage of the Agency’s regulatory support to eliminate the identified violations. NAER reports that the decision of the Balti Court of February 5, 2024, to which Nordgaz Furnizare refers, was announced in accordance with Art. 278-14 Code of Civil Procedure, on the basis that the relevant license holder has eliminated the reasons that led to the suspension of the permitting act, and not because actions of NAER were erroneous. The decision of the Balti Court will come into force 30 days after it is made, unless it is challenged.// 07.02.2024 — InfoMarket
