
Moldovan government has approved the draft of the new Law on the Constitutional Court
According to the Cabinet of Ministers, the document is meant to ensure a unique and modern legislative framework for the organization and activity of the Constitutional Court, in line with the international standards and commitments assumed by the country in the process of accession to the European Union. The new version of the Law on the Constitutional Court was elaborated by merging the Law on the Constitutional Court and the Code of Constitutional Jurisdiction. This decision was adopted because both normative acts contained similar and ineffective provisions, did not meet the standards of legislative clarity and were largely outdated. Through this draft law, the Ministry of Justice provides an updated, clear, consistent and efficient system for the functioning of the Constitutional Court. The draft law includes a number of innovations. The document regulates the disciplinary liability of judges and the application of sanctions. Depending on the seriousness of the misdemeanor, judges may be warned, reprimanded or deprived of their mandate. So far, these sanctions have not been provided for by law. The Constitutional Court would be given greater autonomy and would have the right to adopt its own rules of procedure, following the example of other states. In order to exclude political influence, judges will be obliged to renounce membership in political parties. The law revises the mechanism for filling vacant positions and regulates the deadlines for notifying the competent authorities of the appointment of Constitutional Court judges. In this way, institutional blockages will be avoided and the stability of the Constitutional Court judges will be preserved. The Constitutional Court will have the right to verify, before ratification, the compliance of international treaties with the Moldovan Constitution, in order to ensure compliance with international obligations.
