Moldova: The unregistered property transferred or to be transferred on account of value shares in the property of former agricultural enterprises will become the property of local authorities.
This is provided for by the relevant amendments to the Law on the public property of administrative-territorial units, which were adopted by the Parliament in first reading. The amendments stipulate that the property transferred or to be transferred on account of value shares in the property of former agricultural enterprises, not registered in relevant public registers, becomes the property of the administrative-territorial unit on whose territory they are located. According to the Agency for Land Relations and Cadastre, currently, in most cases, the property of former agricultural enterprises, distributed by value shares, is not registered either with the owners or with the local public administration bodies. Thus, the rights and obligations between the parties are not defined, which leads to the complete or partial destruction of buildings in this category due to lack of proper maintenance. There are also frequent cases where ownership rights to social, cultural or educational facilities were transferred to private persons on account of shares in the property of an agricultural enterprise. This fact generates numerous problems for local public authorities in the effective management of these properties. The legislative initiative proposes to solve the problem of immovable property transferred into private ownership on account of value shares of the property of agricultural enterprises, the shares of this property, as well as the registration of ownership rights in the register of immovable property.
