Moldovan Parliament approves in first reading the law envisaging new provisions on the normative price and procedure of land sale and purchase.

It is about amending article 4 of the law on normative price and procedure of land sale and purchase, which will contribute to the process of agricultural land consolidation, facilitate the creation of forest shelter belts and prevent soil degradation and erosion, protect farmland and increase its productivity. According to the amendments, in order to facilitate the process of agricultural land consolidation, the land included in the field or part of the field, occupied by the designed but not created forest belts, can be sold through direct negotiations, at a price not lower than the normative price of land according to the envisaged tariff. The sale can be carried out on the basis of the application of the owner of the land plots to be consolidated, provided that the owner of these land plots is the same person, and the technological processes of cultivation (maintenance) of the adjacent lands are not disturbed. In the event of sale of land in accordance with these provisions, the buyer shall ensure the development of a project for organizing the territory of an agricultural farm, which also includes lands occupied by the designed but not created forest belts, ensure planting of anti-erosion forest belts and hydrological improvement of the lands according to the new project for organizing the territory developed by a public or private person from this area. The buyer acquires the right of ownership subject to termination in the event of failure to fulfill the stipulated obligations. The term of fulfillment of the obligations by the buyer will be up to 3 years from the date of the land purchase agreement between the parties. If the buyer fails to fulfill its obligations within the period specified in the contract, the right acquired with the termination condition is automatically extinguished, and the transferred right is automatically transferred back to the day of the condition. According to the Ministry of Agriculture, the conditional sale of the aforementioned land plots will increase the consolidation of farmland and stop the erosion of the fertile soil layer of agricultural land. Planting forest strips provides a number of benefits: it reduces wind velocity, increases air and soil moisture, promotes vertical currents at high altitudes, thereby increasing the probability of rainfall, stops erosion and increases soil fertility. // 06.05.2022 – InfoMarket
