
The Secretariat of the Energy Community noted the successful implementation by Moldova of the III Energy Package in the field of electricity and the certification of Moldelectrica as an "Independent System Operator"
The Energy Community announcement welcomes these actions and calls them "a defining moment for Moldova's energy sector." As noted, on July 11, 2023, the NAER of Moldova made a final decision on the certification of the electricity transmission system operator Moldelectrica as an independent system operator. It is emphasized that, almost five years after Moldelectrica filed the first application for certification, the transmission network and system operator is now certified in accordance with European separation standards. At the same time, when making the final decision, NAER fully took into account the Conclusion of the Energy Community Secretariat dated May 12, 2023, which expressed concern about potential conflicts of interest that could affect the independence of the transmission system operator. Between May 12, 2023 and July 11, 2023, all the security measures recommended by the Secretariat to address these risks were implemented: the charter of the SE Moldelectrica was amended to allow for independent investment planning, the Ministry of Energy (as the owner of the system) adopted a compliance program, a compliance agent was appointed, and all state representatives on the boards of directors of public suppliers and manufacturers signed declarations of impartiality. The final decision of the NAER also includes the conditions that must be met in the next nine months to fully ensure the independence of the transmission system operator, namely: strengthening the role of the Secretary of State, appointed to perform the functions of the Ministry of Energy as the sole shareholder of Moldelectrica, and introducing selection procedures applicable to the positions of members of the Administrative Council of SE Moldelectria (after the expiration of the current powers), based on the principles of good faith and transparency, while the majority of members should be elected from among persons who were not members of state administration bodies and state enterprises.// 21.07.2023 — InfoMarket
