
AGEPI is conducting public consultations on the draft Law on Protection of Trade Secrets.
The draft law was developed to eliminate existing gaps in the regulatory framework regarding the rules of protection against illegal acquisition, use and disclosure of trade secrets. It is worth noting that a separate Law on Protection of Trade Secrets will appear in Moldova for the first time. The draft law transposes the provisions of the European Directive on the protection of undisclosed know-how and business information (trade secrets) against unlawful acquisition, use and disclosure. It standardizes the terminology used, which will eliminate situations of ambiguous interpretation of the applied norms, defines the concepts of "trade secret", "trade secret holder", etc. The limits of application of the regulatory framework are established and the ways of obtaining, using and disclosing trade secrets are stipulated. At the same time, the law distinguishes between unlawful and lawful actions that lead to the receipt, use and disclosure of trade secrets. The law enshrines the rights of trade secret holders, defines measures to protect trade secrets and interventions to counteract the illegal use of trade secrets. Also, the liability established in the Civil Code for unlawful acquisition, use or disclosure of trade secrets is transposed into the law.
