
Judicial activity in civil and criminal cases, as well as criminal procedure is suspended during the state of emergency in Moldova.
This decision was taken by the Commission for Emergency Situations after hearing a preliminary report on the risks of taking dubious and dangerous for state security decisions during the state of emergency. In particular, during the state of emergency the commission restricted consideration of civil cases, except for the cases of issuing protective ordinances, taking aliens into state custody and prolongation of that term; ungrounded confiscation of property in favor of the state; approval of forced hospitalization and forced treatment; application of interim measures; collection of alimony for children and establishment of measures of judicial protection. Proceedings in suspended civil cases will resume after the end of the state of emergency. Criminal prosecution and prosecuting judges are only suspended in cases where preliminary measures or measures for the protection of victims and witnesses have been issued or requested; in cases of temporary medical safety measures where minors are involved as victims; in cases where the suspension would endanger the obtaining of evidence or the capture of the suspect, accused or defendant, create a direct risk of new crimes and/or the commission of other crimes. In addition, enforcement proceedings are suspended, except those relating to the prosecution of amounts to be returned to the state; maintenance pensions; the amount of compensation for damage caused by bodily injury, harm to health or death; the recovery of temporary disability benefits and other social security payments provided for by law. // 03.03.2022 - InfoMarket.
