
Moldova will increase the minimum wage in the country, as the Constitutional Court declared unconstitutional the decision to set it at the level of 1,000 lei.
In particular, the Constitutional Court (CC) judges partially satisfied the complaint filed by Dan Perciun, MP, declaring constitutional Article 3 paragraph 4 from the Law on the Procedure for Establishing and Revising the Minimum Wage, which provides that the minimum wage should ensure the minimum subsistence level, including the social and cultural needs of the employee. At the same time, the CC declared unconstitutional the Government Decision No. 550 of July 9, 2014 on setting the national minimum wage, because the national minimum wage of 1,000 lei per month does not ensure the basic needs of workers, being below the subsistence minimum. If the Government will not set a new national minimum salary from August 1, 2022, according to the reasoning of the CC decision, the amount of the national minimum salary will be equal to the amount of the guaranteed minimum salary in the real sector, set in accordance with the Government Decision no.165 of March 9, 2010, point 1.
