
Sanctions for illegal construction to be tightened in Moldova
This is envisaged by the relevant draft law on amendments to the Criminal Code, which Parliament adopted in the first reading. The bill was developed by a group of deputies from the faction of the Action and Solidarity party in order to oppose construction in the absence or in violation of permits, building regulations or legislation. The authors of the bill noted that currently there are no penalties for offenses or criminal sanctions for certain illegal actions or inaction in the field of construction. Among them are exceeding the height limit, violation of the alignment of streets, exceeding the normative indicators of population density or reducing the normative distances between buildings. “Illegal constructions are not only a violation of the law, but also a direct threat to public safety. Violations cause not only visual discomfort, but also an increased risk in the event of an earthquake or other cataclysms. It is important that all these aspects are properly regulated by law, and those responsible for these violations are punished,” MP Lilian Carp notes. The authors of the legislative initiative propose to introduce new norms into the Criminal Code, which provide for punishment for offenses in the field of construction of five or more levels. Sanctions will be applied to individuals or legal entities that have committed violations both at the design or approval stage, and at the construction or commissioning stage. Individuals face a fine of up to 67.5 thousand lei or imprisonment for up to five years. The fine for legal entities will be up to 550 thousand lei with deprivation of the right to hold certain positions or engage in certain activities for up to five years or without it. “The bill is designed to solve two main tasks: close all doors to corruption in the construction industry and impose sanctions on everyone involved in the process of illegal construction,” Lilian Carp concluded.
