
Amcham Moldova asks to establish the duration of the break in shift work in accordance with European standards.
The American Chamber of Commerce in Moldova appealed to the Minister of Labor and Social Protection and the head of the Parliamentary Commission on Social Protection, Health and Family with a request to review the provisions of labor legislation regulating the norms for the duration of the break between shifts. Currently, the Labor Code stipulates that a break cannot be less than twice the working hours of the previous shift (including a meal break). However, according to Amcham, this norm makes it almost impossible to organize work shifts lasting 8 hours with a 30-minute lunch break. In this case, the break between shifts must be at least 17 subsequent hours, which means that instead of 24 hours in a day, you need to have 25.5 hours. The organization refers to Directive 2003/88/EC on certain aspects of the organization of working time, which provides that employers must create conditions for a minimum break of 11 hours in 24 hours. Accordingly, it is proposed that the shift work section of the Moldovan Labor Code establish that the break between shifts cannot be less than 11 consecutive hours.
