
The Constitutional Court of Moldova declared unconstitutional the amendments to the laws "On Medicines" and "On Pharmaceutical Activity", adopted by the parliament on December 16, 2020 at the initiative of the deputies from the "Sor" party.
The corresponding decision was made by the judges of the Constitutional Court on March 11 after considering the request of deputies from the Democratic Party, Platform DA and PAS, which indicated that the amendments to these laws were adopted by parliament, despite a negative opinion from the government and the National Anti-Corruption Center, and the adopted laws threaten public health and pharmaceutical security of the country, since they violate the right to health protection, enshrined in the Constitution, provide for the creation of mobile pharmacies and liberalize the prices of medicines, change the regulation of prices for medicines, etc. Opposition deputies drew attention to the fact that when mobile pharmacies are created, it will be practically impossible to control the sale of medicines in such “pharmacies”. The Cabinet of Ministers acknowledged that the state will not be able to control these so-called "pharmacies", which will not even be able to ensure the proper storage and transportation of medicines. Any sellers without a pharmaceutical education will be able to sell medicines in them, and it will become possible to sell counterfeit medicines, which will have serious consequences for human health.
