The first case concerns NAER's decision of February 28, 2020 on the creation of a mechanism for collecting tariff deviations from Moldovagaz, its affiliated distribution operators and Moldovatransgaz for 2011-2019. On July 27, 2020, Moldovagaz filed a request to the court with a request to suspend and change paragraph (1) of the NAER resolution. Moldovagaz disputes the non-inclusion in tariff deviations of the amount of 239.1 million lei, of which: 102.7 million lei – deviations in natural gas supply activities related to the conversion of national currency; 109.8 million lei – deviations related to the regulated profitability of natural gas supply activities; 26.6 million lei – material, operating costs excluded from the calculation of tariff deviations for 2015-2019. The second case concerns the decision of NAER dated June 4, 2021 on the results of the planned control carried out at Moldovatransgaz for 2017-2019. Later, on July 16, 2021, the Moldovatransgaz company filed a request for a subpoena with a request to suspend and cancel the NAER decision of 04.06.2021. NAER noted the incorrect application of tariffs for natural gas transportation services through the arbitrary application of a subsidy scheme for natural gas transit by Moldovan consumers, carried out in favor of the foreign companies Gazprom and NJSC Naftogaz of Ukraine, which led to a reduction in regulated revenues by 346.89 million lei. The energy regulator believes that by not applying the tariffs set by NAER, Moldovatransgaz caused a significant tariff impact to the detriment of end consumers in Moldova. The third case concerns the NAER's decision of August 6, 2021 to implement the measures provided for by one of the previous resolutions No. 351. On November 24, 2021, the Moldovatransgaz company filed a request to the court asking for the suspension and cancellation of decision No. 351. Moldovatransgaz referred to the fact that through the approval and execution of Decision No. 351, it suffered material damage in the amount of about 462.85 million lei.
