The Regulation on the registration/licensing of foreign insurance or reinsurance companies, as well as their branches in Moldova, has been published.

The corresponding resolution of the National Commission for the Financial Market on the approval of the regulation was published in Monitorul Oficial and partially entered into force. It provides for a two-stage procedure for registering insurance/reinsurance companies from third countries, as well as branches of foreign insurance/reinsurance companies in Moldova: first, applicants must obtain prior permission from the supervisory authority for establishment, and then obtain a license to conduct insurance or reinsurance activities in Moldova. The document establishes the requirements and procedures for prior permission to establish, issue a license to insurance or reinsurance companies and branches of insurance or reinsurance companies from third countries, as well as a list of documents and information that must be submitted to the supervisory authority; conditions for amending the constituent acts; established the procedure for reorganization or liquidation of such entities. Among the documents that foreign insurance / reinsurance companies must submit to the supervisory authority in Moldova there are, among other things, a 3-year business plan, information about the founders and the financial position of each shareholder, including the beneficial owner, etc. Also, applicants must submit an extensive list of internal documents directly related to insurance activities (structure of insurance premiums for each type of insurance, insurance conditions for each class, etc.). Insurance / reinsurance companies from third countries, when registering in Moldova, must have an audit report or other documents confirming the availability of technical equipment and software for processing data related to insurance and / or reinsurance contracts and insurance claims.
