Clarification regarding the recent Dutch Court Decision


In the context of the false and misleading interpretations spread by Bemol Retail SRL (“Bemol Retail”)
and close media of the judgment of the Amsterdam Court of Appeal dated 7 September 2021, we
would like to communicate the following.

In September 2020 Danube Logistics Holding BV submitted a request to a court in the Netherlands
against Bemol Retail and affiliated companies following several actions launched by them in the
Republic of Moldova with the objective to circumvent the decision of the Amsterdam Court of Appeal
dated 11 September 2018. In this final and irrevocable judgment, the Amsterdam Court of Appeal
unambiguously decided that the sale of Danube Logistics SRL in 2011 to Danube Logistics Holding BV
(“Decision on Port Sale”) was legal and transparent, any allegations made by Bemol Retail of
wrongdoing against Mr. Moser were unfounded, and value and price of the transaction were fair.

On 7 September 2021 the Amsterdam Court of Appeal rejected the request of Danube Logistics
Holding BV to halt Bemol Retail’s actions in Moldova which undermine the Decision on Port Sale on
the ground that the court cannot interfere in foreign jurisdictions. However, in the same judgment the
Amsterdam Court of Appeal clearly states that the Decision on Port Sale is not in dispute and therefore
stays in force. Thus, it is evident that the press statements published by Bemol Retail and certain media
are false and manipulative.
