
Mediation will become mandatory for some civil, family and labor disputes
This is provided for by the draft law on mediation and the status of the mediator, approved by the government at a meeting on June 18. The new law provides that before the conflict goes to court, the parties must attend at least one mediation session for certain types of civil, family and labor disputes. The first session will be informative, and the parties will decide whether they want to continue with mediation or go directly to court. It will cost 550 lei - 10% of the minimum wage in the country. For those who try to resolve the conflict through mediation, even if an agreement is not reached, the state fee for filing a case in court will be reduced by 25%. Mediation will be mandatory in civil disputes for claims up to 50 average salaries in the economy: debt collection; damage control; division of property; dissemination of false information or slander; execution of credit, gift, leasing, rental, banking, leasing, insurance contracts or in bankruptcy proceedings. In family disputes, mediation will be mandatory, with the exception of cases of domestic violence. In labor disputes, it will apply to conflicts related to the execution of contractual obligations. The bill also provides for the creation of a Union of Mediators, which will monitor the quality of mediation. Mediators will have to be licensed, undergo annual professional training and adhere to strict ethical standards. The project is expected to reduce the number of cases pending in court, reduce the costs borne by citizens and the state, improve the administration of justice by focusing the courts on complex cases, and facilitate access to rapid solutions and dialogue.
