
Moldova will introduce a temporary mechanism for licensing operators from the Transnistrian region to operate in the energy market of Moldova.
The Ministry of Economic Development and Digitalization submitted for public consultation a draft of amendments and additions to the government decree on regulating the traffic of goods and services that are the subject of foreign trade activities of economic agents of the Transnistrian region, as well as their provision of electronic communications networks and services. Thus, to license activities in the energy sector, economic agents from Transnistria will submit to the issuing authority of the permit document an extract from the State Register of preliminary registration issued by the Public Services Agency. This document must accompany a standard application, which, if necessary, is accompanied by evidence of the availability of technical equipment intended for the licensed activity, as well as qualified personnel. Licenses for activities in the energy sector will be issued for a period of 6 months with the possibility of obtaining a new license upon expiration of the previous one. The explanatory note to the project notes that, as a result of recent changes to the above-mentioned government resolution, economic agents from Transnistria wishing to operate on the Moldovan market must submit an application to the regulatory authority for a permit, attaching the necessary data. Thus, Transnistrian enterprises will be able to obtain licenses/permits to carry out activities by paying the appropriate fees. Today in the energy sector, the validity period of licenses ranges from 5 to 25 years, while the general licensing procedure involves regulation, monitoring and control of activities, which is impossible to ensure in the current conditions. In the future, it will be necessary to determine mechanisms for checking and monitoring compliance by companies from the left bank with all requirements: safety of equipment and industrially hazardous facilities, consumer protection, technical control of electrical networks and installations, verification of personnel compliance, etc. Pending the approval of the necessary documents for regulating and monitoring participants in the energy market, a temporary measure is proposed that will unblock the licensing process for operators from Transnistria: they can repeatedly obtain short-term licenses, with the payment of a fee for the permitting document.
