
In Moldova, the conclusion of contracts for the provision of social services by local public authorities will be simplified.
This is provided for by amendments to the Law on Social Assistance, the Law on Social Services, the Law on Public Procurement and the Law on Local Public Administration, which the Parliament adopted on Thursday in the first reading. According to the chairman of the commission on social protection, health and family Dan Perciun, who is also the author of this initiative, the project brings clarity and simplifies the procedures for concluding contracts for the provision of social services, which may be the best solution for more government agencies to provide the population with the necessary social services. Thus, it is proposed to regulate the activities of local public administration bodies in order to assess, plan and conclude contracts for social services needed by the population. In this regard, central and local public administration authorities will conduct an annual assessment of the need for the provision of social services, involving in this process social service providers and non-profit organizations that protect the rights and interests of citizens receiving social services. The authorities will also approve a program for the development of social services based on the needs identified as a result of the assessment. Herewith, it is proposed to release economic operators (suppliers of social services) from the obligation to provide guarantees for the proper execution of contracts for the provision of social services and / or securing an offer. It is also proposed to eliminate the mandatory conditions for an economic operator entitled to provide social services not to conclude contracts for relevant services with a customer within the last 3 years. “In the context of the underdevelopment of the social services market, such a restriction is not justified, and the local public administration runs the risk of stopping the provision of some state social services, since it will have no one to hire to provide the necessary social services to certain groups of vulnerable beneficiaries,” the author of the initiative believes.
