
The Parliament of Moldova adopted the draft of the new Urban Planning and Construction Code in the final third reading.
This document will establish an unified legislative framework for territory development, urban planning, permitting and implementation of design and construction work, post-utilization of structures, ensuring the quality of structures, building materials and products, state control over compliance with urban planning discipline and the regime for issuing building permits, as well as for the uniform application of provisions legislation in the field of quality in construction on the territory of Moldova, in compliance with public interests. The new Urban Planning and Construction Code is intended to systematize provisions relating to the stages of construction of a structure, starting with concept, design, permitting, implementation, operation, tracking behavior over time, as well as state control in the post-utilization of structures. In relation to state control, the new code contains provisions regarding the purposes of control, facts constituting a violation in the field of quality in construction, the competent authority in the field of state control, the procedure for carrying out state control, etc. The new Code on Urban Planning and Construction contains a number of new important provisions. In particular, the document contains provisions on the procedure for issuing a town planning certificate and a construction/demolition permit. Permits for local construction will be issued only on the basis of urban planning documentation developed, examined, agreed upon and approved in accordance with the law. There are some exceptions: for rural settlements with a population of up to 3,000 inhabitants, an urban planning certificate for design will be issued in accordance with the regulations approved by the government. The simplified procedure will be available to 679 settlements with a population of about 1.5 million people. For the first time in Moldova, a State Register of Companies in the field of urban planning and construction will be created, which will be maintained by the National Inspectorate for Technical Supervision. In addition, the code will provide for an expansion of the list of construction works that can be performed without a town planning certificate and without a building permit. For the first time, an entire chapter of the code will be dedicated to the intervention of state and local public administration in relation to measures to reduce seismic risk in existing structures, as well as in relation to the rehabilitation and modernization of buildings. The new Urban Planning and Construction Code provides for the restoration and thermal modernization of buildings and associated structures, which is an integral part of the state's energy policy and will be implemented through national programs harmonized with European requirements for energy efficiency, environmental protection and sustainable development. It should be noted that, after the entry into force of the code, some laws that have the same regulatory scope will be repealed, for example, the Law on Quality in Construction, the Law on the Fundamentals of Urban Planning and Territory Development and the Law on Permitting Construction Works.
