
Moldovan Parliament passed in the second reading the draft of the new Urban Planning and Construction Code.
This document will establish a unified legislative framework for territory development, urban planning, authorization and execution of design and construction works, post-utilization of constructions, quality assurance of constructions, construction materials and products, state control over the observance of urban planning discipline and the regime of issuing construction permits, as well as for the uniform application of the provisions of the legislation in the field of quality in construction on the territory of Moldova, while respecting the public interest. The new Urban Planning and Construction Code is intended to systematize the provisions related to the stages of construction of a structure, starting from the conception, design, authorization, implementation, operation, monitoring of behavior over time, as well as state control in the post-utilization of structures. With regard to state control, the new code contains provisions concerning the purpose of control, facts constituting a violation in the field of quality in construction, the competent authority in the field of state control, the procedure for carrying out state control, etc. The new Urban Planning and Construction Code contains a number of important new provisions. In particular, the document contains provisions on the procedure for issuing an urban planning certificate and a building/demolition permit. Local construction permits will be issued only on the basis of town-planning documentation that has been developed, expertized, coordinated and approved in accordance with the legislation. Some exceptions are envisaged: for rural settlements with a population of up to 3,000 inhabitants, the town-planning certificate will be issued according to the regulation approved by the government. The simplified procedure will be used by 679 settlements with a population of about 1.5 million people. For the first time in Moldova, the State Register of Companies in the field of town-planning and construction will be created, which will be maintained by the National Inspectorate of Technical Supervision. In addition, the Code will provide for the expansion of the list of construction works that can be performed without an urban planning certificate and a construction permit. For the first time, an entire chapter of the Code will be dedicated to the intervention of the state and local public administration with regard to measures to reduce seismic risk in existing structures, as well as with regard to the rehabilitation and modernization of buildings. The new Urban Planning and Construction Code provides for the rehabilitation and thermal modernization of buildings and related structures. It should be noted that after the Code takes effect, some laws with the same regulatory scope will be repealed, such as the Law on Quality in Construction, the Law on the Basics of Urban Planning and Land Development and the Law on Authorization of Construction Work. // 18.12.2023 - InfoMarket.
