“Since September 2019 bailiffs representing Bemol Retail SRL are unlawfully attempting to
expropriate Danube Logistics Holding BV’s shareholding in Danube Logistics SRL based on a
contested financial claim against Mr. Moser that is entirely unrelated to Danube Logistics
Holding BV.
Danube Logistics SRL is the operator of Giurgiulesti International Free Port. The primary
beneficiary of Danube Logistics Holding BV’s shareholding in Danube Logistics SRL is the
European Bank for Reconstruction and Development. As of today, the EBRD is entitled to
65% of the share sales and dividend proceeds deriving from Danube Logistics Holding BV’s
shareholding in Danube Logistics SRL.
Although the Supreme Court rejected Danube Logistics Holding BV’s and the EBRD’s
requests to revise the court proceedings that established Bemol Retail SRL’s claim against
Mr. Moser, Danube Logistics Holding BV will continue to vigorously defend its rights against
the unlawful expropriation attempt in national and international courts.
In October 2020 the Chisinau Appeals Court ruled in a final and irrevocable judgment that
an order of Bemol Retail SRL’s bailiff to seize Danube Logistics SRL’s dividend payments to
Danube Logistics Holding BV was unlawful. Danube Logistics Holding BV’s and the EBRD’s
requests to cancel the unlawful order of Bemol Retail SRL’s bailiff to seize Danube Logistics
Holding BV’s shareholding in Danube Logistics SRL is currently under consideration by the
Cahul District Court.”
