President Maia Sandu asked the Constitutional Court to review the constitutionality of a number of articles of the Government Law that restrict the president and the resigned government from exercising their powers.
She sent a corresponding request to the Constitutional Court on January 11. In general, the petition of the head of state concerns the right of the president and the retired government with the interim prime minister to carry out personnel changes in exceptional cases and the right of the retired government to sign international treaties under certain conditions. Maia Sandu also asked to declare unconstitutional a number of provisions of the Law on the Government, concerning, in particular, the appointment of acting ministers exclusively from among the members of the resigned government, in conditions where this is not provided for by the Constitution, and at the same time can lead to the creation of even greater dysfunctions in the management of institutions. As Maia Sandu noted, the clarifications of the Constitutional Court on these aspects will clarify the current situation in which the country found itself after the irresponsible actions of some parliament members, the former president and the former prime minister in an attempt to destabilize the situation in the country. According to the current president, the government, even when it resigns, should be able to ensure the government of the country until the next government is appointed. This means the ability to carry out personnel changes, dismiss and appoint high-ranking officials and civil servants under certain conditions, and have access to finance within certain constitutional limits. “The unprecedented situation, deliberately created by the former government in order to make the state even weaker and more vulnerable in the midst of a pandemic and economic crisis, can be resolved through the interpretation of the Constitutional Court and clarification of the gaps and contradictions identified in the request submitted today,” said Maia Sandu. // 11.01.2021 — InfoMarket.
