Minister of Justice Sergiu Litvinenco announced that Moldova won this case in court. He wrote on his page on the social network that on January 10, the Paris Court of Appeal issued a final decision to annul the judgment of the ad hoc arbitration court (Paris) of October 25, 2013 in the case of SPC Stileks (successor of LLC Komstroy and LLC Energoalliance (Ukraine)) against Moldova. The Court held that, in the absence of investments protected by the 1994 Energy Charter Treaty, there was no jurisdiction of the arbitral tribunal. At the same time, in addition to the obligation of SPC Stileks to pay legal costs, the Court of Appeal also ruled to recover 250,000 euros in favor of Moldova as other expenses. Sergiu Litvinenoc recalled that the decision of the ad hoc arbitration court of October 25, 2013 approved the recovery from the account of Moldova in favor of LLC Energoalliance (currently SPC Stileks) 592 million 881 thousand 395 lei and $ 540 thousand. The subject of the case was the alleged non-payment of the SE Moldtranselectro for electricity supplied in 1999-2000. As InfoMarket agency reported earlier, the lawsuit between the Ukrainian company Energoalliance and the Moldovan companies Moldtranselectro and Moldelectrica began back in 2008, when Energoalliance demanded through the court to recover from them a multimillion-dollar debt for electricity supplied at the end of 90 -s. The Moldovan side claims that the claims of Energoalliance against Moldtranselectro and Moldelectrica are illegal. In 2011, Energoalliance applied to the Arbitration Court of Paris, demanding to recover from Moldova the debt for the supply of electricity in 1999-2000. Initially, it was about $20 million, but taking into account inflation, interest and penalties, the amount more than doubled.
