
Moldova will improve the operation of Free Economic Zones, especially in the construction of new facilities in these zones.
This is provided for by amendments to the Law on Free Economic Zones, the Law on Construction Work Permits and the Contravention Code, passed by the Parliament in the first reading. The authors of the legislative initiative are the MPs of the Commission on Economy, Budget and Finance Radu Marian, Valentina Manic and Marina Morozova, members of the PAS (Action and Solidarity) parliamentary faction. The proposed changes stipulate that not only owners of land plots, but also other rights holders, including those with superficies rights, may request permits for the construction of industrial infrastructure in Free Economic Zones. It is proposed to supplement the law on Free Economic Zones (FEZ) with a new provision, according to which the zone administration can transfer the right of superficies on land to FEZ residents, but only after registering their right of superficies in the real estate register. The introduction of these changes will be able to unblock the situation in which some FEZ residents face obstacles in requesting a town planning certificate and a construction permit. The ultimate goal is to encourage the development of investment projects of local and foreign companies registered in FEZ. A new definition will be introduced into the Law on Construction Work Permits - holder of the right to build, which will include the owner of immovable property (land), holder of superficies, as well as persons who are not owners of land, who build and become owners of the erected structure or works purchased before March 1, 2019, which will remain valid until their termination, according to their content established before the enactment of the modernized Civil Code. Currently, there are seven FEZs operating in Moldova, comprising 38 sub-zones.
