
The Moldovan government approved a procedure for determining the competitive nature of economic activity
In particular, at the suggestion of the Ministry of Finance, the Cabinet of Ministers approved a procedure for determining whether the activities carried out by contracting entities in the context of sectoral procurement are subject to direct competition in a market with unrestricted access, in accordance with the provisions of the Law on Procurement in the Energy, Water, Transport, and Postal Services Sectors. Based on this procedure, authorities, state-owned enterprises, or legal entities operating in the energy, water supply, transport, and postal services sectors will be able to obtain an official opinion from the Competition Council regarding the competitive environment in which they operate. In the event of a positive opinion, they will be able to apply their own internal procedures for awarding procurement contracts or organizing design contests in accordance with the principles of sectoral procurement. As noted by the Ministry of Finance, this will provide beneficiaries of the procedure with predictability, speed, and flexibility in the procurement process. At the same time, citizens will have access to more efficient and transparent services.
