
Diaspora representatives and foreign investors will be able to conduct business remotely in Moldova.
The Ministry of Economy has begun drafting a draft law to amend some of the regulations governing the conduct of remote/contactless business in Moldova. This draft law is designed to create conditions for online business management, provide the diaspora and foreign investors with the opportunity to open companies in Moldova online and manage them remotely, and in general will help improve business activities, reduce bureaucracy and costs for entrepreneurs and the state, etc. The document is expected to include two main sections. The first will focus on technical aspects: the procedure for providing IDNP to foreign investors (a mandatory element for registering and administering a remote business); application of eKYC and MobiSign for diaspora and foreign investors; providing digital notarization as an option for domestic entrepreneurs, diaspora and foreign investors; establishment of a legal regime for an electronic notarial document, requirements for its preparation, signing, registration and archiving. The second block of the bill will regulate remote work and remote economic activity. Thus, it is proposed to legalize remote work, to clarify the modes of remuneration, payment of taxes and social benefits. Foreigners working in Moldovan companies without obtaining tax resident status are proposed to be exempted from paying mandatory contributions to state social insurance and compulsory medical insurance. The possibility of remote employment in Moldova of foreign citizens who do not have a residence permit in our country will also be regulated, the rules of electronic interaction of foreigners with the competent authorities that issue various permits will be prescribed. Other amendments will be aimed at clarifying the labor safety regime, medical certificates and risks at work, will regulate the rules for obtaining a Moldovan IT visa in all sectors of the economy (today it is issued only for residents of the IT park), and also provides for the possibility of a remote work permit in Moldova.
