The Cabinet of Ministers drew attention to the fact that in the legislative initiative to supplement Art. 4 of the Public Procurement Law, it is not clear whether both criteria (importer and seller) or only one of them (importer or seller) must be met. It is also noted that in the proposal to supplement Art. 4 refers to both importers and retailers, while the information note to the project only refers to retailers. The Cabinet of Ministers also drew attention to the fact that in the conditions under which the operators of the oil products market have a fixed profit due to inclusion in the specific trading margin and taking into account the fact that they already make a significant contribution to the national budget through general taxes and fees (value added tax, excise fee, license fee, social and medical insurance contributions, etc.), the introduction of another tax will jeopardize the normal operation of the oil products market (including in the current crisis conditions). A significant increase in the tax burden on market operators may jeopardize/limit investments in the development and maintenance of logistics supply chains. In addition, the transfer of 50% of the proceeds from the sale of products to the Population Support Fund will create prerequisites for reducing the tax base for income tax.
