
Authorized entities must apply to the Constitutional Court in order to prevent the suspension of oil products sales in Moldova and the impending collapse of the oil industry
Foreign Investors Association (FIA) addressed a corresponding letter to Parliament Speaker Zinaida Greceanîi, chairmen of parliamentary factions, Interim Prime Minister Aureliu Ciocoi and ANRE leadership. The letter notes that from June 15, 2021, amendments to the law on the oil products market should take effect with provisions that will lead to the suspension of oil products sales by almost all companies participating in the oil industry. While speaking on behalf of the oil industry, FIA draws attention to the impossibility of enforcing the provisions of this law, as it, first of all, is contrary to the law on accounting and financial reporting. FIA Executive Director Ana Groza said that ANRE held three hearings to discuss the new pricing methodology, but no solution was found to the issue on how the oil market will operate after June 15. “ANRE is forced to comply with the new law, but market participants will not violate none of the laws, they will rather have to suspend the sale of oil products,” said Ana Groza. “In particular, it is impossible to set and take into account the price for each fuel consignment imported into the country neither from the accounting perspective, nor from the perspective of the logistics of activities in this market.” The letter details a dozen more reasons why the amendments to the law on the oil products market contradict a number of provisions of the Constitution of the Republic of Moldova, some legislative acts, as well as financial and logistic processes. Ana Groza noted that during the vote, MP Alexandru Oleinic, who represented the new law, stated that the price would be set by ANRE, while the final version of the published law indicated that ANRE approves the new methodology, and the prices should be set by importers. This fact caught ANRE specialists by surprise, but they are forced to comply with the law. If nothing changes in the near future, the companies will have to suspend the import and sale of oil products. Hence, as a result, the budget of Moldova in particular, and the entire economy of the country in general, will suffer great losses. The only way to prevent the coming shortage on the oil products market before parliamentary elections is to appeal to the Constitutional Court, as it has the powers to suspend the law. Thus, negative consequences for Moldova’s economy can be avoided, and after parliamentary elections, the MPs will be able to consider and adopt a new legislative act regulating the oil products market in accordance with the Constitution and current legislation. // 02.06.2021 - InfoMarket.
