
In Moldova, lake owners were required to have an environmental permit for the use of waters for fishing and pay for land under water.
In particular, this is provided for by the relevant amendments to the Land Code, the Law on the Fish Fund, Fisheries and Fish Farming and the Law on the Management of Public Property and its Denationalization, which the Parliament adopted in the second reading. Legislative changes stipulate that in order to use water for fishing, the owner of a hydraulic structure must have an environmental permit for special water use, issued in accordance with the procedure established by law. It is provided that the owners of hydraulic structures enjoy the right to use land plots of the water fund for a fee, being responsible for the maintenance of the water body, including for the strengthening of hydraulic structures. It is also agreed that the owners of hydraulic structures registered in the Real Estate Register before March 1, 2019, located on public property lands owned by the state or administrative-territorial units, pay royalties. Owners of hydraulic structures located on public property lands belonging to the state or administrative-territorial units are obliged, within 6 months from the date of entry into force of the said law, to legalize the possession / use of land by concluding a superficies agreement. The amount of payment will be from 2% to 10% of the standard price of land, calculated for its respective purpose in accordance with the Law on the standard price and the procedure for the sale of land. The draft law also provides for granting administrative-territorial units the right to manage sections of rivers, the course of which crosses their intra-settlement or extra-settlement territory.
