
Moldovan Parliament has passed in the second reading a law aimed at reducing the administrative burden and pressure on businesses
In particular, the MPs approved draft amendments to the Law on State Control and about 40 other legislative acts related to state control, which will optimize and streamline state control. The amendments are aimed at creating a more efficient, predictable and fair system of state control, reducing the burden of control and eliminating disproportionate and unfair restrictive measures. The document was elaborated by the State Chancellery on the basis of proposals submitted by control bodies and the business environment, with the support of the Secretariat of the Economic Council under the Prime Minister and USAID’s “Moldova Institutional and Structural Reforms Activity” program and is aimed at reducing the administrative burden for the business environment and optimizing the time and efforts allocated by the control bodies. The draft law clarifies and eliminates the duplication of functions between control bodies, as well as discrepancies between specialized laws and the general provisions of the Law on state control. The authors of the document propose amendments in the areas of market supervision and consumer protection; technical and construction supervision; labor relations; environmental protection; health care, supervision of medicines and medical devices; food safety; labor migration and others. Among the most important provisions of the draft are the implementation of joint control and elimination of duplication of competencies of control bodies. In particular, joint control of the responsible authorities will be carried out at enterprises selling multiple categories of goods that fall within the competence of different market surveillance authorities However, joint controls will not be compulsory if they are part of a supply chain inspection and are limited to products within the supply chain. Another provision of the instrument concerns the promotion of consultative controls and voluntary compliance. These measures are designed to stimulate entrepreneurship and investment, prevent and minimize the abuse of restrictive measures. Within the second reading, the chairman of the commission for economy, budget and finance, Radu Marian, proposed to supplement the draft law with provisions concerning the activity of control bodies to verify compliance with the tobacco control legislation. More specifically, the obligation to inform the economic agent of the intention to carry out state control was excluded. Thus, the aim is to incentivize permanent, not just temporary, compliance of economic operators with tobacco control legislation. The draft law was also supplemented by an amendment by MP Ana Oglinda, which provides for a more simplified procedure for the authorization of new food products - by notification. In particular, new food products will be able to be introduced on the market only if they are registered in the European Union and the National Agency for Food Safety has been notified about them. Another proposal belongs to MP Alexandr Trubca and concerns the periodicity of technical inspection of motor vehicles. It will be established by a governmental decree, taking into account the safety standards and the specifics of the car fleet in Moldova. According to statistical data, more than 63 thousand enterprises with a total turnover of 286 billion lei operated in Moldova last year.
