
Moldovan Parliament passed in the first reading the draft of the new Law on personal data protection, which complies with EU norms.
According to the document, the legal framework related to personal data protection will be harmonized with the EU legislation. The draft law was elaborated in the context of the implementation of Art. 13 clause (1) of the Association Agreement, according to which Moldova undertook to ensure a high level of personal data protection in accordance with the international instruments of the European Union and the Council of Europe. The document contains provisions that refer to the rights of the data subject, the operator and the person authorized by him, the transfer of personal data to other states or international organizations, specific cases of personal data processing, legal remedies, liability and applicable sanctions for non-compliance with the legal framework. The law also regulates the organization and operation of the National Center for Personal Data Protection (CNPDCP), which will monitor the implementation of the legislation. The new law establishes penalties for violations of the relevant legislation. Any person who considers that his/her right to personal data protection has been violated may file a complaint with the CNPDCP within 1 year from the date of violation. Fines for operators can be up to 1million lei or up to 1% of turnover, in the case of enterprises.
