
In Moldova, the national system of trademark protection will be brought into line with the European one.
The corresponding bill was approved by parliament in the first reading. In particular, in order to modernize the national trademark protection system and provide applicants with a faster, better, organized, consistent, convenient and accessible system for registering trademarks for all interested parties, the Trademark Protection Law as a whole is being revised and a new law is being adopted, fully transposing the norms of Directive (EU) 2015/2436 “On the approximation of the laws of the Member States in relation to trademarks” and, in part, Regulation (EU) 2017/1001 “On the trade mark of the European Union”. The document establishes a number of new procedures for trademarks in the process of registration, legal protection and use. The provisions will apply to individual, collective and certification marks that are the subject of a registration or application for registration in Moldova or an international registration in force in the Republic of Moldova. The bill provides new powers for the State Agency for Intellectual Property, and also details the procedure for registering trademarks, grounds for refusal, requirements for the use of a trademark, and ensuring compliance with existing rights. At the same time, specialized structures will be created responsible for considering all requests provided for by the European requirements for the trademark protection system - the Commission for the Review of Objections, the Commission for the Revocation and Cancellation of Trademark Registrations.
