
In Moldova, new fines will be introduced for enterprises that receive income by incorrectly reflecting production costs.
This is provided for by the relevant amendments to the Law on Entrepreneurship and Enterprises, which the Parliament adopted in the first reading. The amendments stipulate that enterprises that have received income by incorrectly reflecting production costs, the selling price of goods, the volume of construction work and fees for services rendered, thereby not complying with the regulations governing the formation and application of prices in economic relations with state bodies, are subject to a fine in the amount of 10% to 20% of the equivalent of such income. Corresponding revenues and imposed fines are recovered to the state budget on the basis of a decision taken by the Accounts Chamber or the administrative body of the financial inspection under the Ministry of Finance. Enterprises subject to sanctions can reduce the amount of fines imposed by 50% if, within 3 working days from the date of delivery of the decision on sanctions, they pay the full amount of the income received and 50% of the fine. The draft law also stipulates that for enterprises that have applied a commercial allowance for socially significant products that exceeds the limit established by the relevant regulations, a fine of 10% to 20% of the amount of excess income is imposed on persons occupying a responsible position, and a fine of from 40% to 60% of the amount of excess income, for enterprises. According to the authors, in the current wording, the sanction is qualified as exaggerated in relation to public danger, taking into account the amount of damage caused. The fine is collected to the state budget according to the decision taken by the State Tax Service or the administrative financial inspection body under the Ministry of Finance. Persons holding positions of responsibility and companies that have been sanctioned can reduce the amount of the fine imposed by 50% if they pay 50% of the amount of the fine within 3 working days from the date of delivery of the decision to impose sanctions.// 08.06.2023 — InfoMarket
