Amcham Moldova proposes to postpone by another six months the deadline for the entry into force of the new Customs Code of Moldova.

The American Chamber of Commerce in Moldova has sent a letter to the Ministry of Finance proposing to postpone until January 1, 2024 the deadline for the entry into force of the new Customs Code. The law on the introduction of tax and customs policies for the current year stipulated that the new Customs Code would come into force on July 1, 2023. Subsequently, from January 18 to 25, 2023, a draft government decree on the enactment of the new Customs Code was presented for public discussions. However, according to Amcham, for such an important, complex and voluminous document (about 300 pages), which has a significant impact on businesses involved in cross-border trade, a very short time frame was proposed for the study and assessment of its impact. In their initial review of the document, AmCham experts noted that several areas/operations/reports were not reflected in the document. At the same time, the remaining time until the entry into force of the new Customs Code - is extremely short to agree on all related processes, including the commissioning of IT software, both by the Customs Service and by economic agents, which in most cases will suffer from unprepared entry into force of the Customs Code provisions. At the same time, the state financial system will not sufficiently generate the necessary revenues. Amcham asks to organize discussions with the business community (including working group meetings, training sessions, etc.) so that economic agents are aware of the importance, impact and complexity of the new provisions. Let us remind you that the new Customs Code was planned to take effect on January 1, but later it was decided that it will come into force in the second half of 2023. By the end of April the government will revise the regulatory framework and bring it in line with the new Customs Code. As before, the provisions related to submission, change and invalidation of import, export and re-export notifications will take effect 2 years after the new Code takes effect. // 14.02.2023 - InfoMarket
