The procedure of unbundling the Moldovan electric power transmission system operator (TSO) Moldelectrica is advancing.

State Secretary of the Ministry of Infrastructure and Regional Development Constantin Borosan stated this, stressing that the state enterprise Moldelectrica is one step closer to certification as an independent system operator. The National Energy Regulatory Agency (ANRE) approved the candidature of the Compliance Agent proposed by Moldelectrica to meet one of the numerous certification requirements of the Independent System Operator (ISO). The implementation of the Compliance Plan, recently approved by Moldelectrica, will be supervised by the Compliance Agent, in order to guarantee a non-discriminatory and equidistant attitude towards all participants to the electricity market and applicants for access to the transmission network. The Compliance Agent will perform its duties in accordance with the Regulation on the procedure for monitoring compliance programs, the functions of the Compliance Agent are provided for in the provisions of the Law on Electricity. Certification as an independent system operator is one of the mandatory requirements for full membership in ENTSO-E. It should be noted that unbundling is one of the fundamental principles of the Third Energy Package, which requires the separation (unbundling) of competitive activities from monopoly activities within a single company. The legal essence of the unbundling principle is that the owner of networks/infrastructure can engage in activities related to the management of such networks/infrastructure (transportation, storage of resources), but cannot simultaneously be a subject of the adjacent market - to sell or produce resources. In other words, natural monopoly activities (the operation of infrastructure) must be separated from the competitive activities associated with this infrastructure. At the same time, each subject of the market has open access to networks/infrastructure, and the owner of such assets, not being a subject of the market, will be deprived of economic motives and actual opportunities to abuse his position and discriminate against players not affiliated with him.
