The said law came into force after being published in Monitorul Oficial (Official Journal of Moldova) on June 26, according to the statement of the financial department. In this regard, the Ministry of Finance called on contracting organizations that carry out sectoral procurement procedures regulated by this law to carefully read the provisions in this area. As InfoMarket reported earlier, the parliament adopted the Law on Procurement in the Energy, Water Resources, Transport and Postal Services Sectors to fulfill the obligations undertaken by Moldova under the Association Agreement with the EU. The document will regulate the procedure for the award of procurement contracts applied by entities operating in the respective sectors. The law applies to contracts for the procurement of goods, works or services in the energy, water, transport and postal services sectors, other than those specified in Chapter III, the estimated value of which, excluding value added tax, equals or exceeds the following limits: for contracts for the procurement of goods and services, as well as for competitions of decisions - 800 thousand lei; b) for contracts for the procurement of works - 2 million lei; c) for procurement contracts, the subject of which is social and other special services listed in Annex 2 - 1 million lei. It is stipulated that if an international treaty signed by Moldova establishes norms other than those provided for by this law, the norms of the international treaty are applied. Procurement contracts with an estimated value excluding value added tax that do not exceed the specified limits are regulated by the government. With regard to gas and thermal energy, the Law on Procurement in the Energy, Water Resources, Transport and Postal Services Sectors will apply to activities such as the provision or operation of networks designed to provide public services in the field of production, transportation or distribution of gas or heat energy, gas supply or heat supply. In the field of electricity, the law will be applied to the provision or operation of networks designed to provide public services in the field of production, transportation or distribution of electricity, as well as in the field of electricity supply. In addition, the scope of the law includes the provision or operation of networks designed to provide public services in connection with the production, transportation or distribution of drinking water, as well as the supply of drinking water. Another area is related to the provision or operation of networks designed to provide public services in the field of rail transport using automated systems, trolleybuses, buses or cable cars. At the same time, the new law will also apply to activities related to the provision of postal services and other services provided by an organization that also provides postal services.
