The draft law on the cryptoasset market establishes rules governing the issuance, public offering, circulation, and provision of related services for cryptoassets. Its provisions will apply to Moldovan individuals and legal entities, as well as foreign citizens and stateless persons participating in activities on the national cryptoasset market. The bill classifies cryptoassets into e-money tokens, asset-backed tokens, and other types of cryptoassets. The National Commission for the Financial Market will regulate, license, and supervise the issuance and trading of cryptoassets, the activities of relevant service providers, and the prevention of market abuse. The National Bank of Moldova will oversee the issuance and trading of electronic money tokens. Service providers will be required to provide clients with complete and accurate information, publish their pricing policies, fees, and commissions, as well as details on the impact of each cryptoasset on the climate and the environment. The bill establishes requirements for prudential safeguards and corresponding limits, as well as measures to prevent and punish market abuse. Sanctions include warnings, suspension or revocation of licenses, bans on operations, and fines. For individuals, fines can reach several million euros, and for legal entities—tens of millions of euros or 15% of turnover, depending on the nature and severity of the violation.
