On August 10, Monitorul Oficial (the Official Journal of Moldova) published the amendments to the Tax Code, which provide for a reduction from 12% to 8% of the standard VAT rate on food and / or drinks, with the exception of alcoholic products, prepared or unprepared, for human consumption, along with related services that allow their immediate consumption, carried out within the framework of activities classified under Section I of the Classifier of Economic Activities of Moldova. These amendments also provide for the same reduction of the standard VAT rate for accommodation services, regardless of the level of comfort, in a hotel, hotel-apartment, motel, tourist villa, bungalow, tourist boarding house, agri-tourist boarding house, camping site, recreation center or summer camp. Once published in Monitorul Oficial, the amendments took effect. At the same time, from October 1, 2021, the Law on special taxation of services provided in the framework of activities classified under Section I of the Classifier of Economic Activities of Moldova is in force in Moldova. This law provides that for enterprises in the HoReCa sector, a VAT rate of 6% is set for the period of the state of emergency declared in accordance with the provisions of the Law on the regimes of state of emergency, siege and martial law throughout the country by Parliament, and / or for the period of the state of emergency in public health, declared in accordance with the provisions of the Law on State Supervision of Public Health throughout the country by the National Emergency Commission on Public Health. As a reminder, after a prolonged public health emergency due to COVID-19, the Moldovan Parliament declared state of emergency on February 24, 2022 due to threats to national security emanating from the military situation in Ukraine, extending it for another 1.5 years. The last time the state of emergency was extended by Parliament from August 3 for 60 days.
