In Moldova, the maximum size of the commercial discount offered by suppliers to merchants when selling food is limited.

This discount cannot exceed 10% of the supplier's selling price. An exception will be the period of validity of marketing and promotional activities required by the supplier. This is provided for by amendments to the Law on Internal Trade, which the parliament adopted in the second reading on Thursday with the aim of supporting domestic producers of agri-food products. In addition, the approved bill stipulates that the conditions for the supply of goods and the implementation of actions / activities for marketing and advertising are established between the merchant and the supplier on the basis of a contract concluded separately from the contract for the purchase of products, and the period for carrying out actions / activities for marketing and advertising cannot exceed 60 days throughout the year for each product. At the same time, the deputies approved amendments to the Code of Contraventions to introduce fines for violation by a merchant and a supplier of the norms concerning the limitation of commercial discounts established by the Law on Internal Trade. It is stipulated that such a violation will entail the imposition of a fine on individuals in the amount of 50 to 100 сu. (2.5-5 thousand lei), for legal entities in the amount of 200 to 400 cu. (10-20 thousand lei). In addition, it was proposed to supplement the Law on Internal Trade with new concepts: "production process", "food sector regulations", "food safety", which will avoid situations of confusion or multiple interpretations in the application of legislation. As the author of the legislative initiative, Deputy Chairman of the Parliament Alexandru Slusari noted, in general, the amendments will facilitate the access of local producers, especially small ones, to the chain of stores in the country, increase the consumption of local food products and increase the profitability of local producers, create new financial opportunities for modernizing the technologies of local producers or processors. // 22.04.2021 — InfoMarket
