
In Moldova, the trade activities of domestic producers of agricultural products and livestock products will be legalized.
This is provided for by the amendments to the Law on Internal Trade, which are published in Monitorul Oficial and will come into force in six months. According to the document, a home producer is an individual who receives agro-food products as a result of his/her own labor or work together with family members, using a personal plot within the boundaries of a settlement (household), a land plot / land plots for gardening or a land plot / land plots of horticultural partnerships, in order to meet the needs for food and other household (family) needs and not falling under the concept of a merchant. Such producers will be able to sell surplus seasonal agricultural products, as well as surplus livestock products in natural form, live and slaughter weight, subject to compliance with sanitary and veterinary requirements. They will be able to sell their products in markets, substitutions, as well as directly from their own farm with the obligatory completion of the Declaration of the home manufacturer. In the case of trade in products from his/her own farm, the domestic producer must indicate in the declaration the estimated quantity of products for sale, a copy of which is provided to the market administration / local public administration authority in whose territory the trade is carried out, prior to the start of sales. After the expiration of the declaration (1 day - in the markets and 30 days - from their own farm) or at the end of the trade, the home manufacturer must indicate the remainder of unsold products and the amount received. According to the law, domestic producers are not subject to state registration and do not have to submit notifications about the start of trading activities, but they must pay a fee for a trade unit on the market or amplasament. Its size cannot exceed 0.5% of the established guaranteed minimum wage in the real sector. It is also clarified that the category of domestic producers does not include individuals who have turned the cultivation and sale of agri-food products or products of animal origin into a specialized occupation. For example, a home producer who sells livestock products that does not correspond to the climatic zone of Moldova, or if during the year a home producer sold agro-food products in an amount exceeding the amount of personal exemption, etc., may be classified as a profile occupation of the STS. The declaration of a home producer is kept on the register of the market administration or, in the case of amplasments and trade from own farm, - of the local public administration authority within 1 year after the generalization. The government establishes the procedure for registering, summarizing and analyzing data from the declarations of a home manufacturer using the Automated Information System "Payment of Tax Liabilities through the Service for the Collection of Local Taxes and Fees".// 05.04.2021 — InfoMarket
