
Trade unions are opposed to the creation in Moldova of an institute for temporary organization of employment (staff leasing), which, in their opinion, is disadvantageous to workers.
This was stated by the National Confederation of Trade Unions of Moldova, noting that the proposal to regulate staff leasing in the national legislation is actively promoted by the business environment of Moldova through the Economic Council under the Prime Minister. The National Confederation of Trade Unions of Moldova statement indicates that the introduction in Moldova of the institution of temporary organization of employment (staff leasing) will mean the establishment of the right of the employer (user company) to use the employee’s labor through an intermediary (temporary employment agency) without assuming responsibilities (salary payment, training, terms of prior notice, payment of compensation in the event of termination of employment, regular leave, medical leave, study, etc.), which implies, in the opinion of the National Confederation of Trade Unions of Moldova, the regulation of the most modern forms of slavery. According to the National Confederation of Trade Unions of Moldova, this form of employment or, rather, excessive liberalization of labor relations is aimed at reducing the costs of employers at the expense of workers by limiting their legal rights and guarantees. According to trade unions, the institution of staff leasing will lead to instability of the workplace, because of which the employee will have several negative consequences: not providing bank loans; not promotion, accumulation of stress, etc .; restriction of the right to employment for an indefinite period of time in the user company, at least during the time for which the contract is signed with an intermediary (temporary employment agency); the often abusive application of a probationary period for a temporary worker; the use of this form of “employment” not only for temporary tasks, but also for activities of a permanent nature; termination of individual labor contracts concluded for an indefinite period with already employed workers and their transfer to the category of temporary workers (the situation is similar with day laborers); a significant weakening of the protection of workers by the state, etc. The National Confederation of Trade Unions of Moldova emphasizes that the proposed form of temporary employment, that is, through the Temporary Employment Agency, brings benefits and benefits only to the employer and intermediary, the latter benefits from the commission from the account of the temporary worker, and the other avoids the costs associated with maintaining staff; vocational training; rest, medical or study leave; the elimination or reduction of the number or staffing; collective labor agreement; individual labor disputes, etc. The National Confederation of Trade Unions of Moldova is opposed to the promotion and adoption of a bill developed under the auspices of the Economic Council under the Prime Minister, the purpose of which is to regulate personnel leasing (the institution of temporary employment organization) in national legislation.//22.10.2019 — InfoMarket.
