The parliament instructed the Moldovan government to demand the termination of the privatization agreement of Air Moldova.
This is one of the recommendations to the Cabinet, which is contained in the decision of the Parliament following the hearing of the report of the special investigation commission on privatization of Air Moldova. In accordance with the decision of the parliament, the government will have to investigate the reasons for the non-refund of state assistance provided to Air Moldova, including the role of state authorities and measures taken for return or installments of state aid. The Cabinet of Ministers has been instructed to demand that the buyer strictly fulfill contractual obligations within 30 days, taking into account the buyer’s statements about paying off all commercial debts within 3-4 months from the date of privatization. It is agreed that the government will establish the presence of unfulfilled obligations by the buyer and will require the termination of the privatization agreement due to the detection of fraud at its signing, which entails the invalidity of the purchase and sale transaction of SE Air Moldova. The government is also instructed to put forward a claim for damages caused by the buyer not fulfilling his contractual obligations. The Cabinet was also instructed to amend the Law on the Management of Public Property and its Denationalization to eliminate situations of illegality, which are mentioned in the reports of the commission of inquiry. It is stipulated that the Prosecutor General’s Office and the National Anti-Corruption Center will review the compliance with the legislation by the heads of the central state bodies and civil servants who participated in the privatization process of Air Moldova, and if necessary take the necessary measures.
